Terms of Service

Last updated: 2026-10-26

The short version

This summary is here to be read. The full terms below are what you agree to.

SOL ("SOL", "the app") is provided by Ruby Osborne, based in Auckland, New Zealand ("we", "us", "I"). These Terms of Service are the agreement between you and us for your use of SOL. By creating an account or using the app, you accept these terms. If you do not accept them, please do not use SOL.

SOL is a small, independently run product. These terms are written in plain language on purpose, and are not intended to hide anything. If something here is unclear, email ruby.osborne@gmail.com and ask.

1. What SOL is

SOL is a personal health and training companion for iPhone. It takes the information you give it (your onboarding answers, your training logs, your check-ins and your chat messages) together with the Apple Health data you choose to share, and uses that to generate a daily brief, a weekly training plan and conversational replies.

SOL is a general wellness and fitness product. It is not a medical device, and it is not registered or certified as one. SOL does not practise medicine, nursing, dietetics, physiotherapy or any other regulated profession.

2. SOL is not medical advice

This matters more than anything else in these terms.

In an emergency, do not use SOL. If you think you may be having a medical emergency, or you are in danger, or you are thinking about harming yourself, call your local emergency number immediately. In New Zealand that is 111. You can also call or text 1737 in New Zealand to talk to a trained counsellor, free, at any hour. SOL cannot call anyone for you, cannot monitor you and cannot respond in real time.

You should also speak to a clinician before making a significant change to your training or your diet, particularly if you are pregnant, recovering from illness, injury or surgery, managing a chronic condition, taking medication that affects heart rate, sleep, blood sugar or hydration, or are under 18.

3. SOL's output is generated by AI, and it can be wrong

SOL's briefs, weekly plans and chat replies are generated by large language models (currently Anthropic's Claude models, accessed through the Anthropic API). You are reading machine-generated text.

That has consequences you should hold onto:

You stay responsible for your own training decisions. SOL suggests; you decide. Use your own judgement, listen to your body, and stop if something hurts. If a session, load, intensity or dietary suggestion from SOL does not seem right or safe for you, do not do it. We do not accept responsibility for the consequences of following AI-generated suggestions, to the extent the law allows us to say that (see section 9).

4. Acceptable use

Please use SOL for its purpose: your own health and training. Do not:

If you break these rules, we may suspend or close your account. Where it is reasonable to do so, we will tell you why first.

5. Your account

SOL uses Sign in with Apple and nothing else. There is no SOL password to create, forget or leak. Your access depends on your Apple ID and your device, so:

You must be at least 16 years old to use SOL. SOL is not designed for or directed at children.

6. Pricing and subscriptions

SOL is currently provided free of charge and as-is, as an early product that is still being built. There is no subscription, no in-app purchase and no trial that converts into a charge.

Pricing and subscription terms may be introduced in the future. If that happens:

Because SOL is free and early, features can change, pause or be removed, and we do not promise any particular level of availability (see section 9).

7. Your content, and our app

What is yours

You own your data and your content. Your onboarding answers, your health and training data, your chat messages, your logs and your check-ins remain yours. We do not claim ownership of them.

You give us a limited permission to store and process that content for one purpose: running SOL for you. That means holding it on our backend, showing it back to you, and sending the parts needed for a given feature to our AI processor so your brief, plan or reply can be generated. That permission exists to operate the service and nothing else. It is not a licence to publish your content, sell it, or use it for advertising, and it ends when your data is deleted. The Privacy Policy sets out the detail.

You are responsible for the content you put into SOL, including having the right to put it there.

What is ours

SOL itself (the app, the backend, the design, the prompts, the logic, the name and the look of it) belongs to Ruby Osborne and is protected by copyright and other intellectual property rights. These terms give you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, for your own personal, non-commercial use.

You may not copy, modify, distribute, sell, lease, sublicense or create derivative works from the app, or remove any proprietary notices, except where the law expressly allows it despite this clause.

Output

The text SOL generates for you is yours to use and keep for your own purposes. It is generated specifically for you, it may resemble text generated for other people, and we make no claim that it is original or that you can claim exclusive rights in it.

8. Third parties

SOL depends on services we do not control, including Apple (sign-in, the App Store, HealthKit and your device), Amazon Web Services (hosting and storage) and Anthropic (AI generation). Their outages, changes or decisions can affect SOL, and we are not responsible for how those services operate. Your use of Apple's and those providers' services is also governed by their own terms.

9. Disclaimers and limits on our liability

Your New Zealand consumer rights come first. If you acquire SOL as a consumer, the Consumer Guarantees Act 1993 gives you guarantees that cannot be contracted out of, and the Fair Trading Act 1986 contains protections that likewise cannot be excluded. Nothing in these terms limits, excludes or modifies those rights, or any other right you have under New Zealand law that cannot lawfully be excluded. Where a provision of these terms would have that effect, it does not apply to you to that extent. The limits in this section apply only as far as the law allows.

Subject to that, and because SOL is provided free of charge and is still in early development:

We are not excluding liability for anything we cannot lawfully exclude, including liability for fraud, or for death or personal injury caused by our negligence where that exclusion is not permitted.

10. Ending it

You can stop at any time. Sign out, delete the app, and email ruby.osborne@gmail.com if you want your account and data deleted. We will delete them, and the Privacy Policy explains how that works.

We can end it too. We may suspend or close your account, or stop offering SOL altogether, if you breach these terms, if we need to for legal or safety reasons, or if running SOL is no longer viable. Unless the circumstances make it impossible or inappropriate, we will give you reasonable notice and a chance to get your data out first.

When your account ends, your licence to use the app ends. Sections 7 (your content and ours), 9 (disclaimers and liability) and 12 (governing law) survive.

11. Changes to these terms

SOL is actively being built, so these terms will change. When they do, we will update this page and change the "Last updated" date at the top. For changes that materially affect you, such as introducing charges or changing how your data is handled, we will give you notice in the app or by email before the change takes effect. Continuing to use SOL after a change means you accept the updated terms. If you do not accept them, stop using SOL and ask us to delete your data.

12. Governing law

These terms are governed by the laws of New Zealand, and you and we submit to the non-exclusive jurisdiction of the New Zealand courts. If you are a consumer resident somewhere else, this does not deprive you of the protection of mandatory consumer law in your own country.

If any part of these terms turns out to be unenforceable, the rest of it still stands.
